Dear Sir
Following your letter of 3 May 2001 regarding my personal web site (www.mdoLive.com) I have a few queries regarding some of the details.
It is not clear from your letter as to whether or not I have infringed upon or breached the two trademarks of Orange (1559168 and 2025222A, dated 30 June 1995 and 6 February 1998 consecutively). I can fully understand why Orange wishes to protect its identity and investment, however the argument that my web site may "make members of the public less able to distinguish ORANGE goods and services from those of others" seems a little far-fetched.
Over the past week I have discussed the matter with friends, colleagues and visitors to my web site. No one I have spoken to can see how someone could confuse the logo of a major Personal Communications Services company with that of the web site of a camp gay man. Indeed the consensus appears to be that people wonder whether the inverse is in fact true, your client is concerned that people may associate the web site of a camp gay man with Orange.
I agree that the current mdoLive logo is similar to that of Orange but they are also distinctively separate. The mdoLive logo is a bright pink square, if it were orange in colour then at a quick glance a casual visitor may well instinctively make an association to the products and services of your client. Since it is a bright and distinctive pink the colour grabs the visitors eye and attention, hopefully drawing them into the site.
Finally, I found the tone and nature of your letter to be overly aggressive - "Orange requires you". I would be grateful if you could confirm the details and concerns above at your earliest convenience.
